Reneé F. Bergmann is a member of Thorp Reed & Armstrong, LLPs Commercial and Corporate Litigation Group. Her practice area focus is on complex commercial litigation, including mediation and arbitration. Prior to joining the firm, Ms. Bergmann spent six years at the Global 100 firm of Nixon Peabody practicing in both Philadelphia and New York City and litigating a widerange of matters in Pennsylvania, New Jersey and New York.
Ms. Bergmann has specific experience representing regional, national and international clients in commercial contract disputes, business tort claims, franchise litigation and general liability matters. She has represented financial institutions in connection with consumerrelated claims and breach of contract claims. Ms. Bergmann has successfully briefed and argued motions in both state and federal courts and negotiated favorable settlements in substantial contract disputes.
In 2000, Ms. Bergmann was appointed to the Pennsylvania Bar Association Commission on Women in the profession of the Pennsylvania Bar Association, later serving four terms on the Executive Council and two terms as Treasurer of the organization. Ms. Bergmann also served as CoChair of the Communications Committee and CoEditor of the Commissions Newsletter, Voices and Views. Ms. Bergmann is presently a member of the National Association of Women Lawyers (NAWL) and serves on the Programming Committee.
In 2006, Ms. Bergmann was named one of Pennsylvania's Fast Track lawyers by American Lawyer Media. Ms. Bergmann was also honored as a 2005, 2006, 2007 and 2008 Rising Star by Philadelphia Magazine. In 2007 Ms. Bergmann was also a Pennsylvania Bar Association Special Award Recipient, having been selected by the PBA Board of Governors to receive this award for Chairing the very successful 2007 Commission MidYear Event titled "Networking for Women Lawyers, By Women Lawyers" held in Philadelphia on February 22, 2007.
Commercial Litigation
Deposed a lead witness as local counsel in an alleged $40 million fraud action over an asset purchase agreement involving electronic prescription writing software. Case settled very favorably during trial.
Represented a healthcare provider in a New Jersey state court contract dispute, settling on the eve of trial.
Acted as third-chair in multi-million dollar patent litigation pending in the Eastern District of Pennsylvania. The case settled only days away from a jury trial.
Numerous successful oral arguments, injunctions and summary judgment motions in both state and federal courts.
Franchise Litigation
Represented various franchisors from terminating franchisees, securing preliminary injunctions to the trial stage in both the Commonwealth of Pennsylvania and the State of New Jersey.
Bankruptcy Litigation
Represented an Internationally headquartered luggage company in a bankruptcy claim regarding the sale of their trademark. Also, represented a Chapter 7 Trustee in multiple adversary actions.
Insurance Litigation
Represented various insurance companies, including reported decisions, in declaratory judgment actions, including oral arguments and court-ordered, multi-party mediations.
Arbitration/Mediation
Experienced in AAA arbitration, private and court-ordered mediation.
